Personal Training Session Waiver and Assumption of Risk

This Waiver applies to all Personal Training sessions booked through DiscoverTutor and supplements the General Terms of Service and the Student Terms & Conditions. You accept this Waiver once, before booking your first Personal Training session, and it applies to every Personal Training session you book afterward, with any Personal Trainer on DiscoverTutor.

1. Acknowledgment of Risk

Physical exercise and personal training involve inherent risks, including but not limited to muscle strain, joint injury, cardiovascular events, and, in rare cases, serious injury or death. By booking a Personal Training session, you acknowledge and voluntarily accept these risks.

2. Your Health Disclosures

You are responsible for accurately disclosing relevant health information, physical limitations, injuries, and medical conditions to your Personal Trainer, and for consulting a physician before beginning any new exercise program if you have any concern about your ability to participate safely.

3. No Medical Advice

Personal Trainers on DiscoverTutor are not medical professionals unless independently licensed and disclosed as such. Nothing provided during a Personal Training session, including any AI-assisted exercise suggestions, is medical advice, diagnosis, or treatment.

4. Assumption of Risk and Release

To the fullest extent permitted by applicable law, you assume all risk of injury arising from your participation in Personal Training sessions booked through DiscoverTutor, and release DiscoverTutor from liability for such injury, except to the extent caused by DiscoverTutor's own gross negligence or willful misconduct.

5. Accounts and Minors

All DiscoverTutor accounts must be held by an individual 18 years of age or older. Where a Personal Training session is booked for a minor through a parent or guardian's account, the parent or guardian accepts this Waiver on the minor's behalf and is responsible for the accuracy of any health disclosures made for that minor.

6. Applicable Law

This Waiver is governed by the laws applicable to your use of DiscoverTutor, as described in the General Terms of Service.
